- Terms of this sale are Cash, Zelle, PayPal transfer, and debit. All payments must be received the same as cash. Debit and some PayPal transfers may require an additional processing fees. We strongly urge you to make arrangements with your bank beforehand to ensure funds transfer smoothly as there as often limits put in place. Absolutely no checks will be accepted. All bills must be settles on the day of sale.
- Prospective buyers are hereby cautioned and advised by the auction house to examine horses thoroughly prior to purchasing. Each horse offered for auction is sold “As-Is where is with all defects.” There is no warranty of any kind as to the soundness, physical condition, health, disposition, or fitness of any particular purpose of any horse sold in the sale, except in the case where the owner or their representative issues a specific guarantee in advance of the sale. In such cases, the guarantee is strictly by the owner or their representative and not by the auction house. All rights of recourse must be made directly to the prior owner and not through Mike’s Livestock Auction. The auction house is not responsible for buyer or consignor misunderstandings. A recording will be made of the entire auction, which can be used to help settle disputes. “Guarantees” made by the consignor from the auction block” shall not be recognized by the auction house as an enforceable guarantee.
- While every effort has been made to ensure the correctness of the information, the auction staff, management team, and auctioneers are not responsible for errors or omission and assume no liability on their part as to any statements verbal or written regarding horses sold.
- It is the buyers’ responsibility to pay close attention to the auctioneer’s announcements as these announcements take precedence over any printed information in the catalog or other written statements.
- All buyers must register with the office and receive a buyer’s number prior to bidding. Buyer’s numbers require a government-issued photo ID and a fully refundable $100.00 cash deposit. Deposits are refundable on the day of auction only.
- The seller is responsible for any and all guarantees.
- Remote bidding is handled in-house. We STRONGLY recommend you attend the preview in person if possible and understand our process, as it’s a bit different than online bidding.
- If a dispute should arise between or among two or more bidders, the Auctioneer alone will decide the resolution, and their decision shall be absolute and binding on all parties.
- From the time the auctioneer declares the horse sold, the purchases assumes all risk and responsibility for the horse at their expense.
- Payment in full must be received before the office will issue a release.
- Buyers can pick up their new horse on auction day or Sunday during the posted hours. Other days and times can be arranged with the office. Yardage is charged per horse per day for those staying past the designated pickup times.
- Each horse consigned to this sale must pass through the auction sales arena, and all transactions must go through the sales office. The auction house has determined hip numbers and Stall assignments. Hip numbers cannot be removed by the consignor or the buyer while the horse is on-site. Assigned stalls can only be changed by the auction house management. All persons attending this sale do so at their own risk and are urged to use caution around all animals while on Auction grounds. Any item not covered in these “Terms and Conditions” shall be regulated according to the established customs and practices of professional auction companies.
